General Booking Conditions

Article 1: Purpose

These General Booking Conditions (GBC) govern the electronic booking of furnished tourist accommodations offered by AGD to its clients. They aim to maximally protect the interests of the host while outlining the obligations of travelers.

Article 2: Website Publisher

Company Name: AG DESAINT ET FILS
Registered Office: 43, rue Richer, 75009 Paris
Registration Number: RCS PARIS 501284616
EU VAT Number: FR04501284616

Article 3: Characteristics of Accommodations and Availability

We strive to provide accurate information about the accommodations offered. Photographs are indicative and have no contractual value.
Accommodations listed online without a “fully booked” indication are available. In case of unavailability after placing an order, AGD will inform the client by email, mail, or phone. The booking will be canceled, and the client may choose between another stay of equal value, a voucher, or a refund.

Article 4: Contract Conclusion

Before booking, the client verifies the order details, which can be modified before confirmation. Confirming the order summary constitutes acceptance of these GBC. A confirmation email is sent after payment.
The booking must be made in the name of the primary traveler. It is strictly prohibited to book for a third party or transfer the booking to a third party. Sub-booking is also prohibited.
The traveler must verify their identity digitally, as per AGD’s specified procedures, before entering the premises.
Unless proven otherwise, the data recorded by AGD constitutes proof of all transactions. The GBC may be amended at any time. The applicable conditions are those in effect on the booking date. Previous versions can be accessed via the website’s “Contact” page.

Article 5: Price

Prices displayed on the website are in euros, including all French taxes. No price disputes will be accepted after the contract is signed. Additional charges must be paid to the host or their representative at the end of the stay.

Article 6: Payment

AGD uses the secure PayPal payment system (credit card or PayPal account) and the Banque Populaire Cyberplus terminal.

Article 7: Security Deposit

A security deposit is required to cover potential damage to the accommodation, without limiting the traveler’s liability for more extensive damage. Payment of the deposit is a condition for entering the premises.
If no damage is observed and all outstanding charges are paid, the deposit will be refunded within a minimum of 15 days. Otherwise, repair or replacement costs will be deducted, with details provided to the traveler.
Damage not visible at departure may be invoiced after inspection. If repairs prevent re-booking, an indemnity of 500 € per day of unavailability will be charged.

Article 8: Insurance

The traveler is responsible for damage caused to the accommodation, replacement of lost, destroyed, or damaged items, and excess consumption (electricity, water, etc.). They must ensure they have multi-risk insurance covering this type of stay and, if desired, purchase cancellation insurance.
The traveler must provide a valid insurance certificate. Failure to provide, expiration, or falsification of the certificate will result in immediate contract termination.

Article 9: Arrival and Departure

Arrivals are autonomous and possible until 11:00 PM. The traveler must inform AGD of their approximate arrival time, especially if it differs from the scheduled date. In case of no-show without prior notice, the traveler forfeits all rights to the accommodation, and the full amount will be charged. The premises may be re-booked immediately.
Departures must occur by 11:00 AM at the latest. Late departures incur a penalty of 50 € per hour commenced, non-divisible.
In case of non-return of keys, a flat fee of 50 € will be charged.
Any issues observed upon arrival must be reported within 24 hours. By reporting an issue, the traveler authorizes access to the accommodation for intervention without prior notice or their presence.

Article 10: Pets

Pets are not allowed. Any violation incurs a penalty of 250 € and may result in refusal of access.

Article 11: Smoking

Smoking is prohibited inside the accommodations and in common areas. Non-compliance incurs deodorization fees of 250 €.

Article 12: Occupancy Capacity

The number of people specified during booking must be adhered to, determining the tourist tax and insurance coverage. Exceeding the maximum capacity results in the immediate eviction of excess persons without refund or compensation. Occasional and brief visits are permitted.

Article 13: Amenities and Use of Premises

The accommodation is equipped based on the number of people specified. Bed linens and household linens (towels, dishcloths) are provided, except for baby cot linens, which must be supplied by the traveler.
The premises are delivered clean and in working order.
It is forbidden to dispose of objects in sinks, washbasins, bathtubs, bidets, or drains that could cause blockages, under penalty of being charged for repair costs.
The traveler must use the premises reasonably, maintain them properly, and return them in a normal state of cleanliness at departure. Moving furniture between accommodations incurs a 50 € fee.
Certain areas or furniture may be locked and are strictly inaccessible. Any attempt to access these areas results in immediate contract termination and financial penalties.

Article 14: Access for Maintenance and Repairs

The traveler authorizes access to the accommodation for any repair, maintenance, or urgent work without requiring their presence or prior notice. No price reduction can be claimed for urgent work under the host’s responsibility during the stay.
If an intervention is requested by the traveler and is found to be unjustified after inspection by a professional (no issue found or issue caused by the traveler), a flat fee of 150 € will be charged to the traveler and may be deducted from the security deposit.

Article 15: Cleaning

For long stays, mandatory cleaning is performed during the stay, excluding bed linen changes. The traveler must leave the premises in a normal state of cleanliness at departure (dishes washed and stored, linens gathered, floors cleaned, trash removed). A departure cleaning is included in the price for normal use. In case of excessive mess, additional fees will be deducted from the security deposit.

Article 16: Video Surveillance

The building is equipped with cameras with recording devices in the common areas for security purposes. These recordings comply with applicable regulations, including the General Data Protection Regulation (GDPR) and the French Data Protection Act. For more information on data processing, the traveler may refer to Article 23 (Personal Data).

Article 17: Wi-Fi Connection

A Wi-Fi connection is available without guaranteed speed or continuity. No compensation can be claimed in case of malfunction.

Article 18: Prohibition of Establishing Primary Residence

It is strictly prohibited to establish a primary residence in the accommodation, which is intended for temporary tourist use.

Article 19: Termination by the Host

The booking will be terminated automatically in case of serious breach by the traveler of the following obligations:

  • Non-payment of the price or charges by the due date.
  • Significant damage to the premises, furniture, or equipment (intentional or negligent).
  • Repeated disturbances affecting neighbors (noise, odors, visual, or behavioral disturbances).
  • Non-compliance with contractual prohibitions (pets, smoking, parties, exceeding capacity, sub-booking, transfer).
  • Failure to provide a valid insurance certificate, expiration, or falsification of documents.
  • Use of the premises for commercial, professional, industrial, or illegal purposes.
  • Obstruction of plumbing or damage to equipment resulting in repair costs.
  • Refusal of access for mandatory cleaning, maintenance, repairs, urgent work, or visits.
  • Unauthorized access or attempt to access locked areas or furniture.
  • Non-return of keys at the end of the stay or in case of early departure.
  • Non-compliance with digital identity verification.
  • Any other serious breach of contractual or legal obligations, such as non-compliance with the temporary use of the premises or condominium rules.

Article 20: Release of the Accommodation at the End of the Stay

By accepting these GBC, the traveler declares in advance that the accommodation will be vacated at the date and time of the end of the stay specified in the booking. After this deadline, the host will regain full access to the accommodation without prior notice or further formalities. If the traveler leaves personal belongings in the accommodation after this date, they will be removed and stored at a location indicated to the traveler, who may retrieve them according to the host’s specified procedures. The host cannot be held liable for the loss or damage of belongings left behind.

Article 21: Return of the Premises

The traveler undertakes to return the premises in good condition at the end of the contract, whether at its natural expiration or following termination for breach, in accordance with the exit inventory.

Article 22: Cancellation or Modification by the Client

Pursuant to Article L. 221-28 of the French Consumer Code, no right of withdrawal applies. Modification or cancellation conditions depend on the selected rate, with potential deductions from the booking price.

Article 23: Personal Data

Information collected during booking, including identity verification and video surveillance recordings, is processed by AGD to manage bookings, the Client Area, offer personalized services, ensure site security, and combat fraud. Legal basis: contract execution, consent, and legitimate interest for video surveillance.
Data is shared only with AGD’s management and legal department and retained for the duration of the contractual relationship plus 5 years for booking data, or as per regulations for surveillance recordings.
The traveler may access, rectify, request deletion, limit processing, withdraw consent, or exercise data portability rights via the website’s “Contact” page. If “Data Protection” rights are not respected, a complaint may be filed with the CNIL.

Article 24: Applicable Law

This contract is governed by French law. Any dispute regarding its interpretation or execution falls under the jurisdiction of French courts. The French version of the contract prevails in case of discrepancies with a translation.

Article 25: Intellectual Property

All content on the website www.parisuites.com (texts, photos, trademarks, illustrations) is protected by intellectual property rights. Any total or partial reproduction is strictly prohibited.
